This came up on Foxnews.com today. He should have called the police first.

Fanning told investigators that he ran from the scene, grabbed a gun and then returned and shot the intruder, court documents showed. Fanning told police he thought the stranger was drunk and claimed he became afraid when the stranger made threats toward him

So, he left (and was out of danger), But then he returned, and claimed he was in danger, and shot the intruder. Boy is he in for a arrest, trial, and most likely a conviction.

Call the police. It's easy. Hard to understand why this guy would get his gun and return.

Of course all we know is based on news reports, but looks like he easily could have avoided this. Not a self defense situation.

As the old saying goes " guns don't kill people husbands that come home from work early do ".

I thought the wording of Washington state law was interesting:
According to Washington state law, “no person in the state shall be placed in legal jeopardy of any kind whatsoever for protecting by any reasonable means necessary, himself or herself, his or her family, or his or her real or personal property.”
Looks like it gives a lot of protection to the homeowner. Even so, looks like leaving and coming back negates his claim to self defense.
