Title: Nominee Sonia Sotomayor
Post by: CorBon on May 26, 2009, 03:09:58 PM
She doesn’t seem to have a substantial history with the second amendment.  Based on the fact that the Messiah is nominating her, however, I’d have to believe that this subject has been thoroughly discussed with the White House – and I would assume that her thoughts are not like ours.

Here is how she stands with the Second Amendment. As a member of the United States Court of Appeals, for the Second Circuit, the court issued a ruling in Maloney v. Cuomo on January 28, 2009. In that ruling the court declared that the Second Amendment and the right to keep and bear arms applies only to the federal government.  Therefore, states and cities have the legal right to restrict and ban weapons because they are not the federal government.  The case was about a non-firearm weapon but its ruling on the Second Amendment was clear.  You can read the ruling here.

The only thing that is positive is that she will be replacing a anti gun judge and one of the judges that voted against heller. We just have to hope that none of the five judges retire in the next 7 years
