Major Win in Our Circuit

(1/2) > >>

MarcWinkman:
The Third Circuit just ruled in a 2-1 decision that 18-20 year old persons  cannot be restricted from carrying a firearm, including concealed!  I'll try to get a copy of the decision up as soon as I can find a non-Westlaw version.

Just Bill:
YEA!!!

MarcWinkman:
I just sent the agency wide email to my colleagues to start filing motions to dismiss charges of possession of a firearm by a person prohibited that are based upon the defendant being 18, 19, or 20 years old.

Oaklandopen:
Excellent.  I'm a little confused though because the case is speaking to individuals under 21 in possession of a firearm outside their home during a state of emergency.  So is this decision so narrow it may not be used as a more general 18-20 carry case law?

Clarence:
Obviously state or federal laws against 18-20 year olds purchasing handguns or other firearms will now be invalid.
