Title: Do you carry were you're allowed by law but asked not to?
Post by: Grebnehtor on April 25, 2010, 03:13:33 PM
By this I'm referring to places like the Christiana Mall or Regal Movie Theatre. I know these places have signs posted usually (the malls is hidden rather well), but I'm curious if anyone still carries there anyway.  I know all they can do is ask you to leave, but I still wouldn't want to be asked to leave.  I've never had a problem at either place, but both can be equally covered in thug life at times.

Don't have a permit yet but when I get it I won't carry there or I'll avoid the place all together.

If you carry concealed like you're supposed to, "they" don't know.  That's my take anyway.  I have not been to Christiana mall since the 80s so what do I know.

The signs don't have "force of law." They could ask you to leave, but -- if you left promptly and politely -- you would not face criminal charges. It's not your responsibility to read every tiny notice on the door of every business you enter.

However, permit holders should probably respect any request not to carry, even if not strictly required by law. There was a case last year (or in 2008? I forget) where a guy carried openly in a New Castle County park. Mothers in the park with children asked him to leave. He refused. The police came, and they told the mothers that he wasn't breaking the law.
If he was trying to educate the public, he succeeded in the worst way: there was a push to ban guns in county parks.

Let's not educate the public in the worst way.

The signs do not carry any weight in DE.

If those places feel the need to have police officers on duty, they are telling us that it is not safe there.....so hell yes I carry

Ok, perhaps my paranoia is setting in here reading the various posts of who carries, who doesnt etc.

Keep in mind this is a public forum and anyone wanting to make an example out of the next person "caught" at the mall (or even suspected) has several new reasons to make the signs bigger, etc. My experience has been that if they are not already of the mind set that carrying at that verboten place (Christiana Mall) is a great idea, then they are on the Sarah Freaking Brady wagon and think guns are the worst invention ever and should be banned...    you get my drift.

I'm jus' sayin.

I would never confirm or deny when I'm carrying or when I'm not (unless of course asked by the proper authorities).  If you can't tell, I'm not answering.

Just because legal actions won't be taken doesn't mean you should carry there, that really makes you the same as the thugs carrying illegally (just my opinion) I try to respect others and businesses, if they ask you not to carry in there establishment, don't carry there otherwise don't go into there establishment.

Moosie is right of course this is an open forum and everyone can read these post. I will also make this know that two recent member to join the forum are advertising as Law Offices in their profiles just food for thought. As far as where I do and don't carry, I feel that this is something that I prefer to keep to myself as a matter of CYA.  ;)

I feel safe mentioning the mall cuz I rarely go there, last time was before thanksgiving. So for the antis to hold that info and use it against me it will take them a couple years. When it comes to stand alone type retailers that have a sign I do either respect their wishes or not go in.

BTW....is it true their putting a cheesecake factory in the mall?

Mmmmmm.  Beeeer.  Oh.. wait.  Wrong forum.  Yes, The Cheesecake Factory is in and operating!  Check out their menu online before you go...  only because you can sit there all night long just reading all the cheese cake options, let alone the dinner options!!

Fantastic food, service is good.  Getting better.

My vote is for the buffalo bite thingy's as an appetizer (3-4 people required IMO).  Then, for dinner avoid their steaks.  Any of their pasta or chicken dinners are great!, and of course for dessert CHEESECAKE!  I love their chocolate chip coconut cheesecake.  But, any of their desserts are fab!

Oh, and before forking out $30 for a full cheesecake, go to Costco and buy the same one for $10.  Yup.  Same thing.. says so on the box!

@@@@ it.  You guys made me hungry.

Back to my favorite topic...    my point was whether or not you carry when you go to the mall, ANYONE (including feeble minded twits that are anti-gun) can read this forum.  Why give them ammo (no pun intended) to use against us for something that may or may not be occuring.  I'm thinking of things like (and yes.. this would be really far fetched but it has happened in other areas of the country) metal detectors, etc.  I'm not saying you shouldnt carry at the mall, or that I do carry at the mall.  I'm saying we have enough BS to deal with, dont post in a public forum that you're breaking rules with your GUN!

:)  I am saying be safe and eat at the cheesecake factory! LOL

Moosie!

No real desire to go to the Cheese Cake Factory, now if it was PF Changs that's another story.

Something tells me you are spending too much time on the cheesecake website :). As for the gun part, in the 2+ years that I've had my permit I can honestly say that I have no proof that the mall dosent want firearms inside, just what I've heard on here. The few times I've been there I always enter thru an anchor store (parking is better) and have never seen a sign on their door or upon entering the mall from that store. I try my best not to visit stores that have the no firearms signs( haven't been to TGIs in 2 years) because I don't like to lock my gun in the car. While I agree with not giving the anti gunners and extra ammo...haha...I sincerly doubt they're going to put too much time or effort into the online, unprovable, ramblings of somebody that for all they know dosent exist. If they thought that would help the cause they wouldve already printed how people carry in locations with signs.

Back to the cheesecakes...do they have a sign on the door (god I hope not)

WHAT?!!       Sig, I'm sorry but our friendship stops here.  Have you even BEEN to TCF?!

wow.  Just when you think you knew someone....

And Gun Envy, nope, no sign on the door.  And no, I've never seen the sign either (which makes me wonder if there is even a real sign there).

There is.
At the mall entrance facing Costco, between J. C. Penney and the Target-in-Waiting, there is a list of policies on the wall at the right side of the vestibule as you enter. The last policy on the list prohibits firearms.

I just happen to be going that way in a few minutes. I'll bring a camera.

Theyre putting a target at the mall??

ok then... heres a question. The law says that it has to be clearly posted on the entrance, correct? So if they have a sign on the wall inside does that count? And is the sign at every entrance or just that one entrance? I wonder if they posted that for the riff raff that hangs out by the food court.

Yes they are putting a Target at the Mall it should be open by October and I will be poor by November  ;D, its where the old Lord N Taylor was. The sign is on the side wall as you walk in its more of a code of conduct then anything else. And the sign was only at the mall entrances not the store entrances. I don't think there are many of the signs left since they started construction. I think if anything it gives them a reason to ask you to leave if your caught open carrying more then anything else.
Title: I checked out the mall this afternoon
Post by: oldgraygeek on April 26, 2010, 10:16:37 PM
Here's the sign... notice how tiny it is, compared to the mall entrance next to Ruby Tuesday's:
Who the heck bothers to read that?

It gets more interesting when we read the entire sign... and you need to read it all, as "No firearms or illegal weapons" is the last rule on the darn sign:

"Guests who do not act responsibly may be asked to leave. If they refuse to
leave the property, they may be arrested and charged with illegal trespass."

No problem. If someone were to figure out that I am carrying, they can ask me to leave. That's true anywhere. Trying to charge me with a crime would be a problem, unless I refused to leave: my lawyer would eat them alive.

But, here's the other thing:
This same sign does exist at every mall entrance I checked, but it does not exist at any of the outside entrances to J C Penney... nor is there any sign when you enter the mall from J C Penney. I didn't have time to check Macy's, but I believe it's the same over there.

Now we all know where to park when we go to the mall...

Hi everyone.
CCW/CCDW Whatever??? Concealed carry, I think that means that no one should ever know that you are carring a handgun??? The biggest #1- reason that I carry In the first place Is for my safty!!!, #2- Is for anyone that Is with me, as friends and or family, #3-And on the outside chance that I may have to save someone else's life that may be In my space/area that I know may very well die If not for my action??? #3- comes with a very large " IF ", and's and buts???

I'm not a cop, I'm also not hip heavy and I don't carry a handgun to prove anything. So most signs on the walls of malls or any place else are CYA signs to cover any law suite that may come there way??? Other wise they would be like trying to get Into the Georgetown Court house with a metal paper clip In your pocket, or any Court house In Delaware!!!

There Is an old saying, and I'm prity sure most of you guys have heard It before, but anyway,
" I would rather be tried by 12, than be carried by 6 "

" In God we trust, all others pay cash "
 Semper Fi all. Hank.
