This story angers me and scares me at the same time and I say this because the DA prosecuted this case because of the out cry not because of the evidence they had. Very scary, I'm glade to see he did win his freedom.

Just to play devils advocate...he fired without seeing a weapon and without trying to escape the conflict. Add to it the public outcry and the DA probably felt he had to prosecute...like I said, just to play devils advocate. But this story certainly shows the importance of drawing the weapon and firing because you HAVE to and what you might expect afterwards

Im not sure how far the attacker was from him so its hard to say how much time he had to react and run. I think it said he was in his 60"s so I doubt he was out running the guy anyhow. Maybe he had time to get away or handle it differently. But then again maybe the attacker should of not charged him  :-\.

Agreed muleman, not enough info and Im surely not condemning him or his actions but the small amount of info can atleast teach us what to expect in a legal but worst case scenario shooting. IMO the kind of dog can be used as a weapon (pitbulls) and I would look at the owner no differntly than if he had a traditional weapon.

For me, this story also shows the importance of the Golden Rule:

"STFU and wait for your lawyer."

This poor guy was blabbing away, seeking approval and reassurance from the police after what was undoubtedly a tragic and traumatic event.
What he needed to say was, "My name is ______________ and my lawyer's name is _________________," followed by silence.
