It seems like many sources include the Delaware casinos as "no carry" areas but the only hard source I found was a "recreation facility with seating capacity of 2,500". The casinos are multi use areas and I can't help but think there may be many shades of thought here.

I just can't let this go! I'm wondering just what part(s) of Dover Downs is / is not considered casino. The restaurants, hotel and conference rooms are not casinos. However, you have to walk across the gaming floor (I think) to get to some of them.
It seems like a whole lot of folks are saying it’s a no carry area but I don’t see any code supporting that opinion. Perhaps I need to ask a (gasp!) legal professional.

Suggestion, if you want to know so bad, why don't you go ask them at Dover Downs Hotel and casino . Go to the horses mouth.

I plan to ask the horse next visit to Franky’s. I will also write what I think they’ll say and place it in a sealed envelope.
I had hopes someone else had this same curiosity. My wife settled the issue for me by presenting 2 scenarios. 1) If you need to have deadly force and you don’t have it, then a bunch of flowers goes to your funeral. 2) If you use deadly force and the law “comes-a-callin”, then at least you’re alive to tell your story.

I am curious about this myself. Under Title 11 of the Delaware Code it states:
TITLE 11
Crimes and Criminal Procedure
Delaware Criminal Code
CHAPTER 2. GENERAL PROVISIONS CONCERNING OFFENSES
§ 202. All offenses defined by statute.
(a) No conduct constitutes a criminal offense unless it is made a criminal offense by this Criminal Code or by another law.
I cannot find where the Delaware Code states that firearms cannot be carried in the casinos but then again my searching skills are somewhat limited. Keep us up to date on what you find out.

The Casinos fall under state facilities, they are regulated by the Delaware Lottery and all rules are enforced by the division of gaming enforcement (ie DSP). As far as what will happen if your found carrying I think they will ask you to leave.

I gave a call to the Department of Safety and Homeland Security (DSHS) Division of Gaming Enforcement (DGE) which oversees the casinos. They stated that it is not in the Delaware Code about carrying in a casino, that it is an internal policy that says you cannot carry in a casino.

Correct it is not a state law, however the 3 Casino's have internal policies that are set by the State Gaming that state this, I believe that's what the DGE were referring to. Its like a 300 page book telling the Casino's what they can and can not do.

The only thing you can be charged with is Criminal Trespass assuming you are found carrying (improperly concealing your weapon) or you are forced to use deadly force to save yourself or another person. Then, the Casino must call the police and press charges against you. If you are properly carrying and are training to only use deadly force when you are in fear for your life or grave bodily harm, this situation will be a rare occurence. If it does occur and you were able to remove the threat to yourself and possibly save other innocent lives, the chances of the Casino pressing charges is remote. You may even get a free stack of chips. PS I do not recommend going anywhere and consuming alcohol as you move into the impaired judgement area which is not a place to be.

Yes, please post a link. I wont use the general parking. I can't believe there isn't more security in the parking lot, if any at all :-\

Why OPEN a Can of Worms? If your going to carry in the casinos just Keep Your Mouth Shut...It's not inside the casinos anyone is worried about, it's Going back outside to your car where an attack would happen, Especially if you have won money. Better to ask for Forgiveness than to ask for Permission.

I always carry at DE Park. I never ask for permission and I never tell anyone. Never. Anywhere. (Well, until now that is. Shhhhhh!) Even where there are signs. What they don't know won't hurt them.

Handgun law.us states no carrying in state approved casinos. However I still can't find it in Delaware's criminal code. I would call the AG, not the casino.

I for one don't think there is a "State Law" concerning the 3 casinos in Delaware, but I do believe it is a policy of the Delaware Casinos and Fairgrounds, to be a no carry zone, which is their right, just like any other business.
Since I don't gamble my hard earned money at a million to one odds of losing it, I don't go to the casino, so I don't have to worry about losing my money or carrying there, either one.
