Title: .22 Airguns in Delaware?

I am being told be several on-line vendors that .22 cal airguns cannot be shipped to Delaware and that possession of
these here is illegal.

Anyone have any info on this?

I believe that air guns of any caliber cannot be sold by mail to Delaware resident.

That is not correct as I have ordered them on multiple occasions from several vendors.

Just got a craving for a .22 to shoot in the yard.

I've ordered from Amazon, Pyramyd Air and a couple other online sites over the last 2 years with no issues. I bought a Benjamin Marauder .22 PCP air rifle back in 2012 and got hooked on the darn things. Just last fall I ordered the .25 from Amazon and had no problems. I believe back when I looked NJ had restrictions but found nothing for Delaware.

Good to know.  I saw in a catalog that Delaware was listed as a state that restricted mail order air guns.

From the Delaware Code:

ยง 1445 Unlawfully dealing with a dangerous weapon; unclassified misdemeanor.

A person is guilty of unlawfully dealing with a dangerous weapon when:

(1) The person possesses, sells or in any manner has control of:

a. A weapon which by compressed air or by spring discharges or projects a pellet, slug or bullet, except a B.B. or air gun which does not discharge or project a pellet or slug larger than a B.B. shot; or

b. A pellet, slug or bullet, intending that it be used in any weapon prohibited by paragraph (1)a. of this section; or


The size of a BB is defined as 0.171 to 0.173 inches (4.3 to 4.4 mm).
Therefore It would appear to me that most air guns are illegal here.

Any lawyers around?

And yet you can walk into any Walmart, Dicks, etc and buy them and pellet ammo from .177 through to .50.

In-Stock at Walmart Middletown along with .22 pellets.

   you are allowed to hunt with 22 air rifles now.

they changed some rules 2 years ago.  therefore , Dan lindberg had one go through his system and FFL'ed it so the person can hunt with it.

   Because they changed that ,and it is sporting, it is no longer a grey area on that they were a destructive device.
So, if you FFL the unit, no issue. 

  But if you have one , and are shooting it on land, it's considered a firearm , and those laws apply.

  now, Hermans that used to be in concord mall, dicks and others , used to sell Sheridan .20 cal rifles.   somehow, these are in the grey area right now because they are larger than .177.   
    i'm wanting the FX boss .30 next.   I will FFL that so, I don't have issues with being in that grey area. 
  I cant take having that impounded and loosing 2k because of not wanting to FFl it.

Clarance, i cant find a link on this, i remeber reading a article,  on game n fish?  Letting the 22 be used for hunting, maybe law about owning was never changed, ?   Ill keep looking

You are correct that there has been some moves to change this.  I believe DNREC actually supports this to make it available for small game. 

In 2017-18 session it was approved by the senate and voted out of committee but never acted on by the full house. See this: https://legis.delaware.gov/BillDetail/25960

Bottom line is we do have the possibility of rectifying this either legislatively or if need be judicially. 

Senator Pettyjohn regularly is on the Jake Smith show on WGMD 92.7 and next time he is on I will call in to ask him.
