I just received this email from the 9/12 Delaware Patriots.

Call to Action!

We recently received word that SB 163 (the Carney Gun Ban) will be on the Judicial and Community Affairs Committee agenda for Wednesday June 6 th.  This bill is being pushed by Senator Townsend.  If it gets out of committee, it will most likely be on the Senate floor on Thursday.  We think this is an all-out last ditch effort by Sen. Townsend to get something passed.  If this passes,  it will open the flood gates in this session for the rest of the
anti-2 nd
            Amendment legislation that is waiting.

We also believe that they will be putting out SB 209 and SB 210.  These 2 companion bills are a rewrite of the criminal code which has an major impact and unintended consequences.  The intent is to 'clean up' the criminal code but there are many omissions and vague language.  Concealed Carry is one of the many casualties with vague language and omissions.

Please call and email your Senators and Reps, R's and D's and ask them to stop SB 163. 

There are several democrat senators that don't want to see this bill come to the floor because it will force their vote.  That will hurt them in November.  They can put pressure on the Committee Chair, Senator Margaret Rose Henry and Senate Leadership to pull the bill.
 

SB163 Bill

Important to Know before calling your legislators

1.        This legislation does nothing to protect kids or stop school shootings.  This legislation is strictly feel good legislation that does nothing to stop crime or criminal activities. Maryland's nearly identical law did nothing to stop the St. Mary's shooting.

2.        All of the guns listed in the legislation have the same rate of fire as every other semi-auto pistol and revolver not on the list.

3.        The term "assault rifle" came from Germany in WWII for their select-fire, full-auto capable military rifle. The guns on the list are not "assault weapons" because they lack 3-round burst and automatic fire rate capability.  The term "assault rifle" as used today is a pejorative term designed to scare people who don't know any better.

4.        There are 10's of thousands of the guns listed in the legislation owned in Delaware. 

5.        The legislation proposed is unenforceable without gun registration of the "grandfathered" guns - that's the next step.

6.        The vast majority of the guns in the list are used by law abiding citizens for sporting and competition purposes in Delaware.

7.        Many of the rifles listed are used by Delawareans for hunting in other states that allow rifle hunting.

8.        None of the AR-15 style guns in the proposed legislation have ever been used by any military anywhere in the world as a weapon of war.

9.        Many of the guns in the legislation are used for citizen home and business protection and self-defense.

10.      Washington Post fact checker even says that not one of these supposedly "common sense" gun restrictions AWB, would have stopped any of the mass murders since 2012.

11.     Because these guns may not be re-sold in the Delaware market in which they were originally purchased - every one of them will become absolutely worthless - your investment will be gone. You can't even sell them to a junk yard.

12.      The Colt AR-15 was first sold in the United States as a semi-auto hunting rifle in 1964 - the same year Colt sold the select-fire, full-auto capable M-16 to the Army. They are NOT the same rifle.

13.     The fact that a deeply divided 4th Circuit Court of Appeals over-turned two other federal courts in MD means nothing - Delaware is in the 3rd Circuit, not the 4th

I just received this from NRA-ILA.  SB163 will be heard in committee Wednesday.  Send letters to stop this.

Delaware: Senate Committee to Hear Gun Ban Legislation on Wednesday

On Wednesday, June 6, the Delaware Senate Judicial and Community Affairs Committee will be considering a radical gun ban measure similar to what neighboring gun owners in Maryland fought heavily against in 2013.  Introduced as Senate Bill 163 and being pushed by Governor Carney, this anti-gun legislation would ban semi-automatic firearms commonly-owned for self-defense, target shooting and hunting.  Please contact members of the Senate Judicial and Community Affairs Committee immediately and strongly urge them to oppose Senate Bill 163 and any attempt to ban firearms in the First State.


As drafted, this legislation would do nothing to stop crime and would only prevent law-abiding gun owners from being able to defend themselves using the most effective means available.  Criminals, by definition, do not follow the law and will not follow this one if passed.  It is very important that you contact your legislators in opposition to Senate Bill 163 immediately.

Again, please contact members of the Senate Judicial and Community Affairs Committee immediately and strongly urge them to oppose Senate Bill 163, which would ban firearms or impose further gun control in Delaware.

It’s alive and they are trying to ram it through the Senate on a Tuesday June, 19th. It’s imperative that as many 2nd Amendment supporters as possible flood Legislative Hall on th 19th.

Here is what everyone can expect next Tuesday. Sen. Mcbride has stated that he will be putting SB163 on the agenda first thing. After they do the prayer attendance and other business, Senator Henry will yield to Sen. Townsend. (Bad Bryan) Bad Bryan will more than like give some sort of reason for his flawed logic and ask for a suspension of all necessary rules to bring SB163 to the floor. At that time multiple Republicans will then object to suspension. A roll call vote will then take place to see if they can get the 11 yes votes that they need to bring the bill to the floor. Bad Bryan can either table the bill or debate it right then. It is important that we all need to know that THERE WILL BE NO PUBLIC COMMENT. That is what the committee hearing was for. If we get out of line and don't maintain order the President or President Pro Tempore may call recess to remove the chairs from the floor, and close the gallery. Please keep yourselves calm. If you can't excuse yourself to the lobby. If they do not have the 11 votes to suspend the rules the bill dies for the day. He can try to suspend the rules everyday all the way to the end of the session. We need to stay on top of this all the way to July 1st. Thank you all, and God bless each of you.

Bad Bryan CLOWNsend has to be stopped along with his buddy, Gov.Blarney. There is no doubt our rights are being attacked. I just wonder how much money these A holes have received from Soros, Bloomberg and their ilk. It has been said before but these clowns hate the supporters of the 2nd A. Sadly Clownsend is my representative.  All of my e-mails and phone calls to his office have fallen on deaf ears.  He's clearly a liberal attorney who is very selective as to which constitutional rights are deserving of protection and preservation.

Like the preverbial phoenix, Governor Carney's far-reaching gun ban bill, SB 163 sponsored by Senator Townsend, has arisen from the ashes of defeat in the Senate's Judicial and Community Affairs Committee and is on the move again. Read SB 163 here .
We've seen gun ban bills before, but this is more draconian and far-reaching than  Gov. Castle's and Carper's combined!
SB 163 would outlaw thousands upon thousands of semi-auto rifles, pistols and shotguns owned by tens of thousands of law-abiding Delawareans - including America's favorite rifle, the Colt AR-15, and many pistols used by thousands of Delaware home-owners as home and personal defense firearms.
The Synopsis of Sen. Townsend's bill is full of lies, half-truths and falsifications - all designed to make your senators believe that it is both necessary and constitutional. Shame on him! He's a lawyer; he knows better.
Nationally renowned constitutional law expert and successful U.S. Supreme Court Litigator Dr. Stephen P. Halbrook, Esq. has said that SB 163 violates not only the Second Amendment of the US Constitution but also the Due Process Clause, the Equal Protection Clause and even the Commerce Clause.
Delaware's own constitutional law expert, Francis G.X. Pileggi, Esq. testified before the Committee that SB 163 violates Article I Section 20 of Delaware's Constitution.
Senate President Pro Tempore David McBride (D)(SD#13), catering to Governor Carney and his totalitarian anti-gun, anti-freedom socialist agenda has announced that SB 163 will be #1 on the Senate's agenda on when it reconvenes at 2 pm on Tuesday, June 19th. To do that, Senator McBride will invoke a highly unusual and unorthodox procedure calling for a Motion to Suspend Rules which will allow SB 163 to come to the floor despite having been soundly rejected by the Committee as being unconstitutional. This is considered the "NUCLEAR OPTION" and has never been successfully attempted before.
McBride's use of the Motion to Suspend Rules means there could be two votes - one vote to suspend the rules and force SB 163 out of Committee and onto the floor of the Senate, and then a second vote on the bill itself.
The first vote to suspend the rules is, in effect, a condemnation of the Committee and the entire committee process by which business is conducted in the Senate - a dramatic move in and of itself. It is considered an affront to the integrity and tradition in the Senate. It is also an abuse of the minority party by the majority.   
If the first vote succeeds in circumventing the Senate's established committee processes, then a second vote will be held, after debate, on the actual bill, SB 163.
   CALL TO ACTION
 
 
Make no mistake: misguided, anti-gun supporters of this freedom-robbing, unconstitutional bill are attempting to spin the truth and influence public opinion by promoting skewed results from a biased, agenda-pushing telephone poll.
 
We must promote the real opinions of law-abiding, freedom-loving Americans by following the steps outlined below! Your legislators need to hear from all of us! Act now before it's too late!
 
1. Call or email your senator and politely ask that they not only vigorously oppose SB 163 in every way possible, but vote NO on the process to circumvent the established process by motioning to suspend rules. Remind them this action is an affront to the integrity of the Senate and an abuse of power.

I read over the specifics in the bill, again.  This will create a lot of criminals where none previously existed, including me.  How will the state afford all of those trials and prison space???   That will really bust the budget.   "from my cold dead hand...…"

Senator Lavelle is having a coffee meeting on Tuesday morning the 19th from 8 am till 9am at the Drip Cafe 144 Lantana Drive, I am planning on being there to thank him for his support at last weeks committee meeting and for his continued support for that afternoons suspension of the rules vote. If there are any local 2a supporters available to show Senator Lavelle that there is also strong support for the defeat of SB 163 in New Castle County please join me Tuesday morning.  I am also planning to be in Dover later that afternoon to show how much support there is state wide to defeat this bill.

Dear Senators,

Hope this finds all of you well.

I am asking ALL of you to vote NO on SB163.  Also, I'm asking ALL of you to vote NO on the process to circumvent the established process by motioning to suspend rules as this action is an affront to the integrity of the Senate and an abuse of power.  


Since ALL of you are our elected officials I feel you would know better than I, so I ask of you one question:

     What law can you pass that would stop EVIL in a mans heart?  If someone has the desire to kill or injure another and firearms
      are not available, they will just find another way.


A person who is prohibited from possession of firearms will acquire them several ways.  Such as off the streets, steal them, or via straw purchase.
You passed a law increasing the penalty for straw purchases - GOOD JOB!!!  Can we make sure the DA prosecutes it?

Hopefully, you will take the time to answer my one question.

Radnor, I'm making the assumption that the "Brian" you mentioned who had responded to your email was none other than my own State Senator Brian Pettyjohn. Several days ago, I had emailed Brian as well, asking him not to support a change in the rules allowing SB163 to be brought to the floor for a vote and if it was successful, that he vote against of the bill. I was quite surprised when not more than an hour after I sent my email, Brian called me on my cell phone, updated me on the current status of activities regarding SB163, and assured me as well that he would not support a change in the rules that would allow the bill to be presented to the floor for a vote, and if it did make it to the floor, he would definitely be voting against its passage.  It's comforting to know that at least in my district we have a State Senator who understands that these so called anti gun measures are nothing more than "feel good" measures that will do nothing to address the real issues of gun crime. The mental state of the individual who pulls the trigger. Criminals will always be able to gain access to a gun, any gun. If not a gun, a knife, axe, pipe bomb, machete, a car.  It's the individual, not the weapon that needs to be addressed. The warning signs that too often go unnoticed or a failure to be acted upon. Then again I realize that I'm preaching to the choir here. I'll close by saying that it is my sincere hope that tomorrow June 19th, SB163 will be soundly defeated in the Senate if brought to the floor, and that sensibility will return to those attempting to govern us.

 At the Whereabouts last month, I asked your position on SB 163 but you deflected by citing the wishes of your constituents.  I submit that you, as a senator, are to be an informed legislator not a surrogate for an potentially uninformed electorate.  Public opinion is easily influenced or can be outright tricked with skillfully worded polls.  Case in point, the "dihydrogen monoxide" poll that fooled the readers with: "it can suffocate you, it corrodes metal, and can blister your skin."  The majority of pollees signed the petition (see Wikipedia). Yes, you can drown in water, moisture rusts iron, and boiling water can blister your skin. Try surviving without water.  My point here is that public opinion on "assault weapons" is easily influenced when the electorate knows only minimal facts and won't be affected except for additional vulnerability of home invasion.

Given Pareto's 80/20 rule where 80% of the problem can be alleviated with 20% of the effort required to completely solve the problem, I respectively assert that the Beau Biden Mental Health (HB 302) bill will prevent most school shootings when combined with Safe Storage of Firearms (HB 366) if you can get that bill out of the Senate Judiciary Committee.

 SB 163 is a sledge-hammer approach to gun violence by punishing the lawful gun owner.  The "assault weapons" restrictions will do little to nothing to limit the availability of the weapons and will be difficult to enforce.  The negative effect of SB 163 is to divert law enforcement from the active criminals.  Quoting a DSP detective's recent comment, "It's not you guys we worry about, it's the felons."
  SB 163 is a feel-good bill that is being attempted to rush through by suspension of the rules.  Please vote NO.

It describes how we protected my sister from the real and imminent threat of violent attack from her ex-husband by bringing her to our home, where our so-called “assault weapons” both deterred the attack and all but guaranteed her safety if the attack had happened.
SB 163 would create two classes of citizens: those with the right to own the tools necessary to protect their families, and those who will never have that right. You’re a decent human being, and a Democrat, so you have worked against the creation of privileged and under-privileged classes all your career.

Just noticed this line on SB 163 synopsis
The names Newtown, Aurora, San Bernardino, Orlando, Las Vegas, and Parkland, among others, have become synonymous with tragic killing of innocent, unsuspecting Americans of all ages and backgrounds...

Seems that another mass shooting (https://en.m.wikipedia.org/wiki/Sutherland_Springs_church_shooting) with 26 dead and 20 wounded doesn't deserve mentioning.  Oh, that was in a church in Sutherland Springs, TX, committed by a mentally ill critter that wasn't reported by the Air Force, and was stopped by an armed citizen with his own "assault weapon". (The nut job isn't counted in the fatalities but an unborn child is).

Attention Delaware Senators:

This is a slap in the face to active duty military who will not be able to PCS to Delaware with their lawfully owned and purchased firearms.

Also retiring military now not permitted to return to Delaware with their lawfully purchased property.

They have sacrificed much to defend our freedoms and our constitution.  Now one more freedom is to be taken away?

Think before you vote on this.
