Title: Bump Stock Ban
Post by: MarkB on December 20, 2018, 02:33:10 PM
The Justice Department has banned possession of bump stocks and you have 90 days to destroy them or turn them in.  I don't own a bump stock and I don't see a practical use for them.  That said, this ban, in it's current form, is unconstitutional for the failure to provide for "just compensation" for the bump stocks that the government has "seized' by this ban.  I've attached text of a letter I sent to Dover regarding the Delaware bump stock bam.

"It's been awhile since I wrote to you. I hope all is well with you and yours.  I'm writing to ask for your help with House Bill 300 when it gets to the Senate.  I ask that you oppose the bill in it's current form.  It is in direct violation of the Fifth Amendment of the United States (i.e. "nor shall private property be taken for public use, without just compensation") and Article I, Bill of Rights, Section 8 of the Delaware Constitution (i.e. "nor shall any person's property be taken or applied to public use without the consent of his or her representatives, and without compensation being made.").  If this bill becomes law without any compensation for the bump stocks that are "taken" by the State then it will be declared unconstitutional in any lawsuit filed."

I have a problem with the part that says "taken for public use" Bump stocks are not being taken for public use, but to be destroyed.
I also see no practical use for them and think those that bought then should have put more thought into it, instead of "going all Rambo", I gotta have one.
