We may not yet be trapped behind enemy lines but we definitely have sappers in the wire. The fight at the front just went nuclear.
Not content to ban standard capacity magazines (SS1 to SB 6), every American Sporting Rifle (HB 450 w/ HA #1), and deprive adults under 21 of their constitutional rights (HB 451), Democrat anti-gun zealots in both the House and Senate are now striving to drive Delaware’s innocent, law-abiding stocking dealers out of business with Senate Bill 302.
Their goal is to deny you a place to shop for guns, ammo, targets, cleaning gear, loading components and other firearms-related accessories.

SENATE BILL 302
Is a thinly veiled end-run around the federal Protection of Lawful commerce in Arms Act – in fact, they admit as much in their WHEREAS clauses at the beginning of the bill. This is exactly what New York is trying to do – nothing new here – all part of a national attack on the firearms industry by the Democratic Party, national and local.
Will create an entirely new civil cause of action for “Public Nuisance” defined as “a condition which injures, endangers, or threatens to injure or endanger or contributes to injury or endangerment of the health, safety, peace, comfort, or convenience of others or otherwise constitutes a public nuisance under common law.” That means that when your neighbor thinks you are making too much noise, the shop that sold you anything that you used to make that noise can be sued, even if they did not know what you were doing.
It will repeal the fair, common-sense protections currently in place that allow dealers to do business without fear (and expense) of frivolous lawsuits so long as they are conducting the background checks required by law and otherwise doing their due diligence.
It will allow the dealer to be sued when bad guys make straw purchases of firearms even if they did not know it was a straw purchase
It exposes the dealer to being sued if a bad guy purchases and uses any “firearm-related product” – which means anything from a gun or ammunition to a sling swivel, to a scope, to rings and bases, to anything else one might consider a “firearm-related product” so long as it is a “firearm accessory”.
It vastly expands the power of the Attorney General to harass gun dealers and anyone else in the “firearms industry”, and drive them out of business
And the list of “terribles” goes on and on.
Senate Bill 302 would apply to your local stocking dealer and to any “person engaged in the sale, manufacturing, distribution, importing or marketing of a firearm-related product.”
That means the magazine, newspaper, radio station, or TV station or TV program that advertises a “firearm-related product” could be sued even if they had no idea what the so-called nuisance-maker was doing.
Because it includes advertising (marketing) it could even be used to prohibit radio, television and newspapers from even carrying advertisements – and magazines like the NRA Official Journals.
And they know it is all constitutionally suspect because they try to insolate themselves from such attacks within the body of the bill.

Call, write, email, text and talk to these legislators listed above and tell them you know what they are trying to do – and tell them to stop.
Call, write, email, text and talk to your Senator and Representative and tell them to VOTE NO when this bill comes before them. Tell them you know what it is trying too do and that it is totally unacceptable.
