SB 163 (Assault Weapons Ban) failed in committee - NRA-ILA

SB 163 (Modern S[orting rifle Ban) has failed by 3-2 in committee.  This is from the NRA-ILA.

Delaware: Gun Ban Legislation Fails to Pass Senate Committee

Today, the Senate Judicial and Community Affairs Committee voted 3-2 to defeat radical gun ban measure, Senate Bill 163.  Introduced as Senate Bill 163 and pushed by Governor Carney, this anti-gun legislation sought to ban semi-automatic firearms commonly-owned for self-defense, target shooting and hunting.  While this is an important step in the ultimate defeat of SB 163, this legislation will remain alive in the legislature until the end of session on June 30.  NRA members must stay vigilant in their opposition to gun control this session.  

Thank you to NRA Members and Second Amendment supporters who contacted committee members in opposition to this anti-gun legislation.  Special thanks to those committee members who voted NO on Senate Bill 163, Senator Bruce Ennis, Senator Gregory Lavelle, and Senator Dave Lawson.  Please contact those Senators and thank them for supporting your Second Amendment rights by opposing SB 163.

I received a message from senator Lavelle to that effect, yea for our side.  I helped in his last campaign, and he has never let us down.  A real believer in the Constitution, the States and ours..

My Statement on Today's SB 163 Committee Hearing
 
After months of listening to constituents, and following today's hearing, I decided not to release SB 163 from committee. As we heard repeatedly today, this piece of legislation clearly violates Article 1, Section 20 of the Delaware Constitution. Unlike many on the other side of the aisle, I consider the Constitution the first hurdle any piece of legislation must get over, and this bill clearly fails that test. There are firearms listed in this legislation that are used for the defense of home, for hunting and for recreation. All of those uses are constitutionally guaranteed.
 
In addition, Senator Townsend testified in the committee hearing that as of today, there is no agreed-upon method by which legal gun owners would prove that they owned firearms prior to the implementation of the law. Legislation of this magnitude is too important to not be fully fleshed out prior to passage. The idea that we would figure it out over the next few months is woefully inadequate.
 
Additionally, it should be made clear that today's outcome - the failure of SB 163 to pass out of committee - was the preferred and designed outcome of the Senate Democrats. Senator McBride and his leadership team never wanted this bill to see the floor, and they want to pin its demise on me for political gain in an election year. Senator McBride could have assigned this bill to any committee - including his own Executive committee. He did not. He chose this outcome so he and his caucus would not have to face a vote on the floor in the face of significant citizen opposition.
 
I have voted for and/or sponsored many pieces of sensible firearm legislation, including legislation to ban bump stocks, legislation to increase penalties for gun crimes and straw purchases, and the Beau Biden Gun Violence Act. I believe that our schools should increase their security measures in order to reduce the possibility of a tragic event like we have seen elsewhere this year. But as Maryland and others have learned, no amount of gun legislation will prevent a determined individual with evil in their hearts from acting on those impulses.
 
I believe we have taken great strides forward this session in keeping Delawareans safe. I look forward to working with my fellow legislators and the Governor to take additional steps this year, specifically in the area of school safety. And I believe we can do all of that while following our Constitution.

Thank you emails sent to the three who voted NO on this bill. Great statement from Sen.Lavelle and he sounds like my kind of guy. I have but one question. Will the DemoRATS try something sneaky before June 30? I also think Sen.Ennis did a great job and voted across party lines. Yep he is an old Blue Dog Dem. and there are not many around.

I believe Sen. Ennis carries an "A" rating with the NRA.
