The bad guy was leaving through the door. A mistake to shoot at him. What if a bystander was in the hallway?

I agree.  Unless there is more to this I would certainly cover the bad guys exit but not pull the trigger as long as he was leaving.  We need to keep our emotions in check.   I don’t see any info saying the intruder was armed.  Ordering him to stop is a good idea but if he runs, I would not shoot.  I am also not sold on the idea of “warning shots” for several obvious reasons.

Shooting a perp in the back in DE. will get you put in prison. When a perp is in retreat they are no longer a treat to you, so the law says. You shoot someone in the back, you are also shooting yourself in the foot....
