California “Assault Weapon” Ban Overturned Again (sort of)

Federal Judge Benitez has again ruled to overturn the California Assault Weapon ban.   His reasoning is posted here and you might want to go get a cup of coffee and go through it. It is a masterpiece of logic and jurisprudence. 

Don’t jump up and down in a victory dance.  Yet.   As before a stay of 10 days has been given for the predicted appeal to the EnBanc 9th circuit who will eventually rule with some convoluted verbiage that the ban is constitutional.   

This will be of course appealed to the US Supreme Court that may or may not take it up.

If you get a feeling of deja vu, you probably read the posts about the magazine ban decision by Benitez a couple weeks ago.
