DE Permit to Purchase Update

Well gang, our elected communist overlords have gone and done it.  They passed the permit to purchase bill into law despite the Fourth Circuit Court of Appeals, a distinctly anti-gun Circuit, striking down Maryland's near identical law previously.  Of note, Tom Neuberger has already filed suit against the State in the District of Delaware challenging this law.  Hopefully, we draw a judge that has half a brain.  If not, off to the Third Circuit it will be.

I'm not saying that SCOTUS does nothing,  but they sure as hell are treated like what they hand down doesn't matter to this and other blue states

Thanks for the update.  Most of us know what is going on but it helps to hear from the experts.

 My concern is that 65% of the registered republicans stayed home the last time.  How do we get them of their butts?

I personally think that people have had enough and most will vote their pocketbooks, having lost 20% of spending power.  They may not like orange man, but hate the inflated prices even more.

Not to be a skeptic, but most left voters in NCC are too brilliant to understand that....  And this is where things need to CHANGE!!!

Add to that the border situation, and the obvious alzheimer's setting in; don't see how anyone in their right mind can go to the polls and vote for this guy.  They may vote for free money, though, and that remains a problem.  But even then- taxpayers do NOT want to 'forgive' college debt.  That is ridiculous. And now I heard he wants to release more of the Strategic Petroleum Reserve (again) to buy votes.

As an OLD Delaware native, I learned long ago that Joe has no problems at all with spending OP money.  And never saw a tax increase he didn't support.  But as a contractor, heard he won't pay contractors with his own money.

As a side note related to the Permit to Purchase, the criteria for Permit to Purchase are identical to the criteria for a CCDW license in Delaware.  It really wouldn't make any sense to get the Permit to Purchase versus License to Carry Concealed.

I check the print version al the New Urinal for CCW postings.  They are really getting up there, many per week.  Smart people.  But our comrades in the legislature will ban that next year???

Haven't read the BS law but would you be able to lend a handgun to someone looking to qual for purchasing? Or maybe stay at the range with the person during their 100 round live fire?

That would be permissible so long as there is no transfer of possession.  Keep in mind that under Delaware law, possession is not necessarily synonymous with ownership.  If you are lending a weapon, I would highly recommend that you do so in a manner that doesn't involve you being away from it (i.e. don't have your buddy over, hand them a cased firearm and send them on their way for them to later return said loaner).

Thanks Mark, that clarifies what I had thought on the subject.   I was afraid that the loan was not legal.

Yea I never meant it as an out-of-sight loan.  But of course that takes time away from the owner as well having to stay during the live fire
